Session IV: The progress of investment in the sector and the socio-environmental permits and licenses

    Speaker of Session IV with Anthony Laub and Jaime Quijandría

    The first speaker of this session was Beatriz Merino, president of Peruvian Society of Hydrocarbons,, she indicated that the state weakness relies in leaving the definition of the rules or the application of the given rules in the private sector’s hands, considering that the optimal way to resolve the conflicts or tension between the population and the energy industry goes through:

    • Trustworthy definition of the dimension of the costs and risks of energy projects, taking into consideration the technical knowledge as well as the perception of the stakeholders involved.
    • Implementation of dialogue mechanisms that allow the understanding between the parties with a special emphasis of the scope of the projects.
    • Requirement of mechanisms that ensure agreements and solve conflicts in a timely manner.

     

    For the State to develop these mechanisms, the following principles should be pursued:

    • Transparency
    • Accountability: regulator/ regulated
    • Stability and consistency
    • Approach in results and not in means
    • Interrelationship of resources: achieving what is sought

     

    Our second speaker was Alejandro Martínez, president of Colombian Petroleum Association, whose presentation (See Presentation) outlined what the challenges and opportunities in the oil industry in Colombia are, highlighting the socio-environmental challenges of this sector. To that end, he showed statistics of time frames for environmental licenses and how best practices reduce the implementation period of the prior consultations.

    Dr. Martinez emphasized the importance of the Government-Industry agreement; whose basis to achieve satisfying results are: objective analysis based on actual data, identification of common objectives and activities with goals, and participation of attendees at the highest level.

    The panel session was made up by:

    • Erlon Arfelli, Energy Director of Odebrecht Energía del Perú, , provided information about the development of Chaglla Hydroelectrical Power Plant project by Odebrecht ( See Presentation) ) and his experience in processing environmental licenses. He showed his gratitude for L&Q Consultants and Lawyers’ contribution on this project.
    • Mariano Castro, Vice Minister of Environmental Management, focused his presentation (See Presentation) on the efforts being implemented by the Ministry to achieve continuous improvement in environmental impact assessment.
    • Iván Lanegra,, ex Vice Minister of Interculturality indicated the important of mechanisms focused on reducing the analysis periods of the environmental studies; moreover, he mentioned the pending agenda of the Ministry of the Environment.
    • Christian Laub, CEO of Credicorp Capital, stressed, on one side, the need for clear political decisions; and on the other, he pointed out the risk before the lack of team capable of carrying out large projects. He also detailed the need of a strong leadership, naming as an example the case of Eng. Quijandría in Camisea Project.

     

    CLOSING CEREMONY

    Anthony Laub, delivered the general conclusions of each of the sessions developed. Vice Minister Edwin Quintanilla finally closed this Congress, appreciating the different contributions and proposals made throughout the day
